Talk to the physician/practitioner about their process for submitting a PFL claim. The important health benefits of Paid Family Leave are only a few reasons why it’s so critical to increase access to this benefit for all workers and families. The EDD has a program for self-employed individuals and independent contractors called Disability Insurance Elective Coverage (DIEC). Premiums are based on the net profits you reported to the IRS on your Schedule SE for the previous tax year and are paid on a quarterly basis. You can contact the Department of Labor Wage and Hour Division or the Civil Rights Department, which has responsibility over employment and leave issues, including employment termination during a family leave.

Ineligibility or Conflicting Wages

Employees must submit their PFL claims on or after the first day of their leave, but no later than 41 days after their leave begins. Once California’s claim filing platform is completed and launched, however, employees will be able to file a claim up to 30 days in advance of the first compensable day for benefits. This form asks employers to verify the information the employee provided on their claim. Employers must complete and return the paper form to EDD within two working days. Beginning in 2021, eligible employees receive 67% of their average weekly wage, up to 67% of the statewide average weekly wage for up to 12 weeks of leave. Most benefit payments are issued within two weeks after the EDD receives a properly completed claim online or by mail.

Understanding Paid Leave

An employee is responsible for notifying the University that they intend to apply for PFL benefits. Leave Administration will provide AWW’s and ADW via a weekly file to the Hartford. For any type of foreseeable PFL, an employee must provide at least 30 days’ notice. Otherwise, the employee must give notice as soon as possible. If you are a mother transitioning from a pregnancy-related disability claim, no additional documents are needed. You must complete the application and send all the supporting documents so we can process your claim. Reporting this information ensures you receive the correct benefit amount and prevents an overpayment. For state taxes, PFL benefit payments are not reportable by California pursuant to Revenue and Taxation Code Section 17083. You may not receive Disability Insurance or Unemployment Insurance benefits for the same period in which PFL benefits are paid. To file an EDD PFL claim, the person must be a part-time or full-time employee who contributes to State Disability Insurance through payroll deductions. Eligibility also includes self-employed Californians or independent contractors who contribute to the Disability Insurance Coverage Program. Your job may be protected by other laws, such as the Family and Medical Leave Act or the California Family Rights Act. When does an employee need to give notice of their California Paid Family Leave?

After you have created an account and logged back in to myEDD, select SDI Online, which will direct you to the SDI Online Registration page. Select your account type and complete the requested information. Once your SDI Online registration is complete, log in to myEDD again and select SDI Online once more to be directed to your Home page to file your claim. If your employer has a voluntary plan and you need to apply for family leave, talk to your employer’s personnel or benefits office for more information. If you are unsure if you are eligible to receive PFL benefits, apply. We will let you know if you meet eligibility requirements.

The fastest and easiest way to file a PFL claim is through SDI Online. Remember that PFL and SDI provide replacement income, but they do not protect your job or require your employer to hold your job for you. You need to separately qualify for Pregnancy Disability Leave or the California Family Rights Act to make sure that your job will be held for you while you are away from work. It is your duty to confirm all forms you submit to us are complete and signed.
